UDHR - Universal Human Rights + Education

The Universal Declaration of Human Rights (UDHR) recognizes education as a fundamental human right. Specifically, Article 26 states that "Everyone has the right to education". This includes the right to free and compulsory primary education, as well as access to secondary and higher education. The UDHR also recognizes that education should be directed towards the full development of the human personality and the strengthening of respect for human rights and fundamental freedoms. The right to education is an essential component of realizing other human rights and promoting equality, justice, and peace in society.

US - Right to Education

In the United States, the right to education is guaranteed by the 14th Amendment of the Constitution. This has been interpreted to mean that all children have a constitutional right to a basic education, regardless of their race, ethnicity, or socioeconomic status. Additionally, the federal government has enacted laws to protect students with disabilities and ensure their access to a free and appropriate education.

At the same time, education is primarily the responsibility of the individual states and funding for public schools is primarily provided at the state and local level. In New York City, the right to education is guaranteed by state and federal law, as well as the New York City Charter. All children between the ages of 5 and 21 are entitled to a free public education, regardless of their immigration status.
